Sir:

I have the honor to report that July 30th I received a telephone message from U.S. Customs Inspector W. H. Stevenson at Moores Jct, N.Y., stating that six Italians had arrived from Montreal on the Hemmingford branch of the G.T. Ry. One of them, Chas. Ponzi, had the other five Italians in charge, and was to meet a Mr. O'Brian at Moores Jct. I had them all held by Mr. Stevenson, and brought to Rouses Point for examination. Upon examination I found that they were entering the United States unlawfully, inviolation of Sec. 8 of the Immigration law, and I held them in custody at Rouses Point from July 30th till Aug. 1st, when I proceeded to Plattsburgh and made complaint before U.S. Com'r Gililand charging Chas. Ponzi with violating Sec. 8 of the Immigration law, and secured a warrant of arrest. This I turned over to U.S. Dep. Marshall [(b)(7)(c)], who came to Rouses Point Aug. 1st, served the warrant and took Chas. Ponzi and the other five Italians to jail at Plattsburg, pending their hearing Aug. 10th. For some unknown reason Ass't Atty Owen could not be present at the hearing Aug. 10th and the case was put over to Aug. 15th when it was again deferred by the defendent's lawyer asking for adjournment for one week. Aug. 22nd the case was finally disposed of and Ponzi was held to await the action of the U.S. Grand Jury at Auburn court in October. Chas. Ponzi was held under $1000. bail, failing to procure which he was again committed to jail. The other five Italians are still held as U.S. Witnesses.
